The terms that govern your use of this website and any commercial relationship you enter into with YOUMEGA — Xiamen Mega Garment Co., Ltd.

1. About these terms

These Terms of Service ("Terms") apply to anyone who visits iyoumega.com ("the Site") or enters into a commercial relationship with Xiamen Mega Garment Co., Ltd. (厦门迈弘格服饰有限公司, "YOUMEGA", "we", "us"). By using the Site or sending us an inquiry you agree to these Terms.

If you place an order with us, the specific terms in your signed Pro-Forma Invoice (PI) or Sales Contract take precedence over these general Terms in case of conflict.

2. Who we are and what we sell

YOUMEGA is a private label and OEM/ODM activewear manufacturer founded in 2017, operating under our own import/export license in Xiamen, China. We produce yoga wear, training wear, sports bras, matching sets, shorts, swimwear and seamless activewear for brand-owners and distributors worldwide. We do not sell to end consumers.

3. Inquiries and quotations

Information shared on this Site, including product images, MOQ, lead times and pricing examples, is for general guidance only and does not constitute a binding offer. Final pricing, MOQ and lead times depend on fabric availability, color, logo method, packaging and current factory schedule, and will be confirmed in writing in the quotation we send you.

Quotations remain valid for 30 days from the date of issue unless otherwise stated.

4. Samples

• Sample fees are charged upfront before sample production begins.
• Sample lead time is approximately 7 days for stock styles with custom logo, and 12–15 days for full custom OEM/ODM development.
• Revisions on samples are free of charge until you formally approve the sample.
• Sample fees are refundable against your bulk order when you place an order that meets our standard MOQ.
• International courier shipping for samples is paid by the buyer unless otherwise agreed in writing.

5. MOQ and bulk orders

• Stock styles with custom logo: from 100 sets, mixed colors and sizes allowed.
• Full custom OEM/ODM development: 300–500 pcs per style per color.
• Custom Pantone color matching: 500 pcs per color.
• Bulk lead time: 30–50 days from confirmed deposit, depending on order complexity, fabric availability and printing method.

6. Payment terms

• New clients: 30% deposit before production starts, 70% balance before shipment.
• Repeat clients: 30% deposit before production starts, 70% balance against B/L copy.
• Accepted methods: T/T (bank wire), L/C (Letter of Credit), PayPal, Western Union.
• All prices are in USD unless otherwise stated. Bank charges on the buyer's side are paid by the buyer.

7. Shipping and Incoterms

We ship under any of the following Incoterms 2020: EXW, FOB, CIF, DDP. Risk transfers to the buyer in accordance with the Incoterm specified in the signed PI. We file customs declarations under our own export license and provide standard documentation (Commercial Invoice, Packing List, B/L or AWB, Certificate of Origin if requested).

Lead times for ocean freight (typically 25–40 days transit) and air freight (typically 5–10 days transit) are estimates based on carrier schedules and are not guaranteed. We are not liable for delays caused by carriers, customs authorities, weather or force majeure.

8. Quality control and claims

We perform in-house quality control at the AQL 2.5 standard before shipment. Each order is inspected for measurements, stitching, color consistency, logo placement, packaging and accessories. Photos and video of bulk inspection can be provided on request.

Any quality claim must be submitted in writing within 15 days of receipt of goods, with photos and a clear description of the issue and the affected quantity. Claims submitted later may not be accepted. If a quality issue is confirmed and is our responsibility, we will offer one of the following remedies at our discretion: replacement in your next order, partial refund, or repair where feasible.

9. Intellectual property and confidentiality

All logos, designs, tech packs, patterns, color combinations, brand names and creative materials provided by you remain your sole property. We treat all such materials as strictly confidential and use them only to manufacture your order.

We will not reproduce, sell, share, or use your designs for any other customer or for our own catalog without your written permission. This obligation continues indefinitely after our relationship ends.

Conversely, our stock-style patterns, our standard size charts and any in-house designs we offer to you remain our intellectual property unless we have agreed otherwise in writing.

10. Website content and trademarks

The Site, its design, code, photographs and written content are owned by YOUMEGA or used with permission. You may share links to the Site freely but you may not copy, reproduce or republish substantial portions of the Site without our written permission. Logos and brand names belonging to other companies that may appear on the Site (such as certifications, partner brands or case-study clients) belong to their respective owners.

11. Limitation of liability

To the maximum extent permitted by law, YOUMEGA's total liability to you for any claim arising out of or related to a transaction with us is limited to the value of the specific order in dispute. We are not liable for any indirect, consequential, incidental or punitive damages, including lost profits, lost sales, loss of brand reputation, or business interruption.

12. Force majeure

Neither party is liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to acts of government, customs delays, natural disasters, pandemics, war, strikes, labor shortages, port closures or fabric supply chain disruptions. In such cases we will communicate promptly and work with you in good faith to find an alternative solution.

13. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China. Any dispute that cannot be resolved through good-faith negotiation will be referred to arbitration at the China International Economic and Trade Arbitration Commission (CIETAC) in Beijing, conducted in English, with the arbitral award being final and binding on both parties.

14. Changes to these terms

We may update these Terms from time to time. The date at the top of this page will reflect the most recent revision. Continued use of the Site or continued business with us after a revision constitutes acceptance of the updated Terms.
